UK Expansion Worker Visa

If you are planning to expand your business activities to the UK, opening a branch is an option for your business. You can send one of the parent company’s employees to set up your company’s UK branch. UK Expansion Worker will help your employee or one of the shareholders or directors to come to the UK on a temporary assignment to establish your business’ presence in the UK.

This category has replaced the former route Sole Representative of an Overseas Business. UK Expansion Worker Route is a sponsored visa, meaning the employer must obtain a Sponsorship Licence to sponsor their UK Expansion Worker.

The assessment process depends on a number of requirements, which are listed below.

What are the Requirements of the UK Expansion Worker Visa?

In order to successfully apply for the UK Expansion Worker Visa, the applicant must meet the following requirements:

  • You must be currently working for the sponsor group and have worked outside the UK for the sponsor company overseas (outside the UK) for at least 12 months before your application. There is an exception if you were earning over £73,900 or equivalent overseas.
  • There is an eligible occupation limitation. The role you will be filling must be in the eligible occupations list for this specific visa.
  • The general gross UK annual salary requirement is £45,800 or 100% of the pro-rated going rate for the selected occupation, whichever is higher.
  • Applicants will not need to satisfy an English language requirement.
  • This category does not lead to settlement in the UK.
  • The leave is granted for 12 months and can be extended for another 12 months iif need be.

One important change in this category, compared to the Sole Representative of an Overseas Business it replaced, is that UK Expansion Worker no longer limits the amount of shares you can have at the overseas business. This means the sole shareholders or majority partners of a company can come to the UK to establish the presence of their UK branch under this visa category.

It is also important to note that the UK Expansion Worker category can be used only if the Overseas business does not have a presence in the UK yet. For sponsorship licence applications for the Overseas business, the requirement is proving the “digital footprint” in the UK, not business activities.
