SETTLEMENT (GENERAL)

This category applies to non-EU individuals who want to apply for permanent settlement or Indefinite Leave to Remain (ILR) in the UK after having lived legally in the UK for a period of five years. This is relevant to applicants who are applying from within the UK and who are in the UK under certain immigration categories. ILR gives the applicants permission to remain in the UK without any time restrictions.
Eligibility

Applicants must have been in the UK for five years under specified immigration categories such as:

  • Tier 1 (except for Post-Study work) or Tier 2
  • Work permit holder
  • Businessperson
  • Innovator
  • Investor
  • Minister of religion
  • Writer, composer or artist
  • UK ancestry 

Furthermore, applicants are required to demonstrate that they have a good knowledge of language and life in the UK by:

  • Passing the ‘Life in the UK test’  (English speakers) or
  • Passing a course in English for speakers of other languages which involves citizenship material (Non-English speakers)

Fees and Processing

Applications for settlement can be made via post (majority of applications are processed within six months) or through a public enquiry office (majority of applications are processed with 24 hours); however, applications made through a public enquiry office are subject to a fee, are not open to all applicants, and are intended for straightforward applications only. As part of the process, biometric information (fingerprint and facial image data) is required to be collected.
