This category applies to non-EU individuals who want to apply for permanent settlement or Indefinite Leave to Remain (ILR) in the UK as the partner of a British citizen or a settled person. A partner includes a husband, wife, and civil or unmarried or same-sex partner. ILR gives the applicants permission to remain in the UK without any time restrictions.

Individuals applying under this category would:

  • Currently have permission to be in the UK as the partner of a British citizen or settled person
  • Have lived in the UK for two years under this category
  • Still be planning to live with and be together with their British citizen or settled person partner. 

For applicants who stayed in the UK as an unmarried or same-sex partner and now want to settle in the UK as the husband, wife or civil partner of the same person, the two year qualifying period will have started on the later of:

  • The date when the applicant received permission to remain in the UK as an unmarried or same-sex partner or
  • The date on which you arrived in the UK. 

Applicants are also required to demonstrate that they have a good knowledge of language and life in the UK. This can be achieved by:

  • Passing the ‘Life in the UK test’  (English speakers) or
  • Passing a course in English for speakers of other languages which involves citizenship material (Non-English speakers).

Fees and Processing

Applications for settlement can be made via post (majority of applications are processed within six months), through a public enquiry office (majority of applications are processed with 24 hours) or through a settlement checking service.

Applications made through a public enquiry office are subject to a fee, are not open to all applicants, and are intended for straightforward applications only. As part of the process, biometric information (fingerprint and facial image data) is required to be collected.

A settlement checking service is offered by local authorities, in conjunction with the UK Border Agency and is only in relation to the settlement of partners. The service includes having your form checked for completeness, ensuring you have paid the correct application fee, copying and returning documents and posting the application form to the UK Border Agency. This service is undertaken for a fee as instructed by your local authority.
